“TRY ON BOARD” SERVICE POLICY

This Policy governs the “Try On Board” service offered by MAGUSA MARINE, which allows customers to select and book products online, try them on board a boat and subsequently confirm the purchase of only the items they have chosen.
The service is available exclusively within the operating area specified by MAGUSA MARINE (Marina d’Arechi Salerno Port Village, Via Salvatore Allende, Salerno) and constitutes a service that is separate from the online sale of products.
1. Nature of the service
The service is an exclusive experience designed to allow customers to view and try products directly on board their own boat before deciding whether to purchase them.
Unless otherwise provided in this Policy, the Website Terms and Conditions, the Returns, Refunds and Right of Withdrawal Policy, the Privacy Policy and any additional conditions published on the website shall remain applicable.
Trying the products does not constitute an immediate sale and does not automatically result in the conclusion of a purchase contract.
The purchase of products takes place exclusively at a later stage, following the customer’s express confirmation exclusively through the online system.
2. Booking procedure and product selection
The customer selects online the products they wish to try and submits a service request, specifying the date, time and logistical information required to arrange delivery on board.
The information provided by the customer must be complete and accurate. Any inaccuracies may make it impossible to provide the service correctly.
3. Payment pre-authorisation
Access to the service requires a pre-authorisation for the total amount of the selected products.
The pre-authorisation is used exclusively to verify the validity of the payment method and temporarily reserve the amounts corresponding to the selected garments.
This transaction does not constitute a final charge and does not result in the automatic purchase of the products.
The amount actually charged will be determined exclusively on the basis of the products that the customer decides to keep and confirm at the end of the fitting session.
4. Available service options
Where available, the customer may select one of the available service options.
A) Delivery and collection only
Under this option, the appointed staff member delivers the products to the boat and temporarily leaves them in the customer’s possession for the entire duration of the fitting session. At the end of the agreed period, the staff member will collect any products that have not been purchased.
During this period, the customer assumes full responsibility for the custody obligations set out in this Policy.
B) Personal Shopper on board
Where available, the customer may request the Personal Shopper service.
Under this option, a MAGUSA MARINE representative remains on board throughout the fitting session, assisting the customer with product selection, checking the fit, coordinating garments and selecting the final items to be purchased.
The assistance is provided exclusively as a commercial advisory service and does not involve any assumption of responsibility for the customer’s product choices.
The presence of the Personal Shopper does not release the customer from the custody obligations set out in this Policy.
5. Performance of the service
The “Try On Board” service is provided on the boat specified by the customer in the booking request, on the previously confirmed days and at the previously confirmed times, subject to suitable operating, logistical, weather and safety conditions.
The products will be delivered exclusively to the customer or to another person previously authorised by the customer and present on board.
At the time of delivery, the customer must check the number and condition of the products and report any immediately visible irregularities.
Any complaints concerning delivery must be raised when the products are received; otherwise, the delivery will be considered to have been properly completed.
Delivery of the products for the fitting session does not transfer ownership of the products, which remains with MAGUSA MARINE at all times until the purchase has been completed.
During the fitting session, the customer may assess the products received and freely decide which items to purchase.
Products not selected for purchase must be returned to the MAGUSA MARINE representative at the end of the fitting session in the same condition in which they were delivered, except for normal handling required to assess their fit and characteristics.
6. Duration of the service
Unless otherwise expressly agreed and confirmed by MAGUSA MARINE, the fitting session will have the maximum duration specified during the booking process, starting from the moment the products are delivered on board.
Once the agreed period has expired, the appointed staff member will collect the products that have not been purchased or, in the case of the service with an assistant on board, conclude the fitting session.
Any request to extend the service may be accepted exclusively with the prior authorisation of MAGUSA MARINE and subject to organisational requirements.
7. Cost of the service
The “Try On Board” service is available at a fixed cost of €30.00 (thirty/00) for each booking, regardless of the service option selected by the customer.
The same fee applies both to the “Delivery and collection” option and to the “Personal Shopper on board” option and covers the organisation, product preparation, booking management, delivery, any assistance provided during the fitting session, collection of products not purchased and any other logistical and organisational activities connected with the service.
This amount is independent of any subsequent product purchase and is non-refundable once the service has been properly provided.
8. Purchase confirmation
At the end of the fitting session, the Customer informs the Magusa Marine staff which products they wish to purchase and which products they wish to return. Products not confirmed by the Customer are collected at the same time by the appointed staff member, in accordance with the procedures set out in these rules.
The Magusa Marine representative records only the products actually selected by the Customer through the company’s in-store management system, completing the relevant sales transaction.
The amount finally charged to the Customer will be determined exclusively in relation to the products actually selected and recorded by the representative, in addition to any fee payable for the “Try On Board” service.
Only confirmed products will be considered sold and charged definitively.
9. Timing of charges
Following the customer’s confirmation of the products, MAGUSA MARINE will proceed with the final charge exclusively for the items purchased.
Any pre-authorised amount will be adjusted or released according to the outcome of the final selection and the processing times of the payment networks used.
10. Operating conditions of the service
The service is subject to availability and may be amended, suspended or not confirmed due to logistical, weather, organisational or safety conditions.
MAGUSA MARINE reserves the right to reschedule the service or propose alternative solutions if performance becomes impossible.
11. Liability, custody of products and customer obligations
From the moment of delivery until the products are returned or their purchase is confirmed, the customer assumes custody of the products received.
During this period, the customer must take the utmost care of the products and adopt every necessary precaution to prevent deterioration, loss, theft, damage or alteration.
The customer is also responsible for the actions of any persons present on board, guests, crew members, associates, family members, any animals present and anyone who has access to the products during the fitting session.
Any damage, loss or improper use will result in charges corresponding to the value of the products concerned.
The customer agrees to return all products complete with their original tags, internal labels, any security seals and any accessories.
The products must be returned in the same condition in which they were delivered, except for what is strictly necessary to try their size and fit.
12. Loss, theft or failure to return
The customer is responsible for the loss, misplacement, theft, destruction or failure to return products received for the fitting session, regardless of the cause of the event, unless the customer proves that the event was caused by unforeseen circumstances or force majeure.
In such circumstances, MAGUSA MARINE may charge the full price of the product that has not been returned by using the pre-authorisation provided by the customer.
The right to claim compensation for any additional damage remains unaffected.
13. Inspection of products at the end of the fitting session
At the time of collection, the appointed staff member will carry out a preliminary inspection of the condition of the products.
The absence of an immediate complaint does not constitute a waiver of MAGUSA MARINE’s rights.
If defects, damage, alterations or irregularities that could not be immediately identified at the time of collection subsequently become apparent, MAGUSA MARINE may notify the customer within a reasonable period following the return of the products and provide appropriate supporting documentation.
14. Right of withdrawal
Products purchased following the fitting session are subject to the standard rules applicable to online purchases, as specified in the Returns, Refunds and Right of Withdrawal Policy available on the website, which forms an integral part of the contractual relationship between the parties.
As an independent service, the “Try On Board” service is governed by the provisions of applicable law relating to services, including the loss of the right of withdrawal where the service has been fully performed, without prejudice to the right of withdrawal relating to purchased products.
15. Information required for the service
For the proper provision of the service, information may be requested including:
the customer’s identity, contact details, information about the boat, mooring location, time slot and selected products.
The customer is responsible for the accuracy of the information provided.
16. Cancellation and modification of the booking
The customer may request the cancellation or modification of the “Try On Board” service booking up to 2 (two) hours before the confirmed start time of the fitting session, in accordance with the procedures specified in the service confirmation. In this case, the service fee will be refunded in full or, at the Customer’s request and subject to Magusa Marine’s availability, the booking may be rescheduled for another date or time slot.
Requests for modification or cancellation received after this deadline, or the customer’s failure to attend on the agreed date and at the agreed time, will not entitle the customer to a refund of the service fee, except in duly documented cases of force majeure or where Magusa Marine decides otherwise at its discretion.
17. Geographical and operational restrictions
The service is available exclusively within the area specified by MAGUSA MARINE (Marina d’Arechi Salerno Port Village, Via Salvatore Allende, Salerno).
The provision of the service is not guaranteed outside the operating areas or under conditions that do not allow safe or organisationally feasible access to the boat.
18. Processing of personal data
Personal data collected in connection with the booking and management of the service is processed in compliance with applicable law and in accordance with the Privacy Policy published on the website.
The data is used exclusively for purposes connected with managing the service, communicating with the customer, managing the logistics of the fitting session and complying with any applicable legal obligations.
