Returns, Right of Withdrawal, Refunds and Legal Guarantee Policy

This Policy governs, pursuant to Articles 52 et seq. of Italian Legislative Decree No. 206/2005 (the Italian Consumer Code), the procedures for exercising the right of withdrawal, the procedures relating to returns and refunds, and the consumer rights concerning the legal guarantee of conformity for purchases made through the MAGUSA Marine website, operated by MAGUSA S.R.L.
This Policy forms an integral part of the Terms and Conditions of Sale and Services and must be read together with them, as well as with the Privacy Policy and, where applicable, the “Try On Board” Service Policy.
The purpose of this Policy is to clearly and transparently explain how customers may exercise the rights granted under applicable law and the procedures adopted by MAGUSA Marine when handling post-purchase requests.
1. Scope of Application
This Policy applies to orders placed through the MAGUSA Marine website by consumers within the meaning of Article 3 of the Italian Consumer Code.
MAGUSA Marine manages online orders exclusively through in-store collection. Home delivery is not available. Purchases made through the website constitute distance contracts even where products are collected exclusively from the physical store. Therefore, except in the cases excluded by law, consumers are entitled to the withdrawal rights provided by the Italian Consumer Code.
For purchases made directly from the physical store, the right of withdrawal applicable to distance contracts does not apply, unless otherwise required by law or provided through a specific commercial initiative offered by MAGUSA Marine.
2. Collection of Products
Orders placed through the website are available exclusively for collection from the store indicated during the checkout process.
Collection of the product is the moment at which the consumer acquires physical possession of the goods. Where applicable, the statutory withdrawal period begins from that moment.
Product collection procedures are governed by the Terms and Conditions of Sale available on the website, which form an integral part of the contractual terms applicable to online purchases. Customers are encouraged to read them carefully before placing an order in order to understand the applicable collection procedures.
3. Right of Withdrawal
Except in the cases excluded by law, consumers have the right to withdraw from the contract without providing any reason within 14 (fourteen) days.
For contracts relating to goods, the withdrawal period begins on the day on which the consumer, or a third party designated by the consumer, acquires physical possession of the product.
For MAGUSA Marine services purchased through the website, including the “Try On Board” service, the 14 (fourteen)-day withdrawal period begins on the day the customer completes the service booking and receives the relevant confirmation.
The “Try On Board” service constitutes a service that is separate and independent from the sale of products.
For any products purchased following the fitting session, the 14-day withdrawal period begins on the day the customer physically receives the purchased products, namely when the garments that the customer has confirmed they wish to purchase are delivered on board.
Where the customer expressly requests that the “Try On Board” service be performed before the expiry of the 14-day period following the booking, and the service is fully performed with the customer’s prior express consent and acknowledgement that the right of withdrawal will be lost once the service has been fully performed, the right of withdrawal may no longer be exercised in relation to the completed service.
The right of withdrawal relating to purchased products remains fully exercisable in accordance with the procedures set out in this Policy.

Exercising the right of withdrawal does not involve any penalty and customers are not required to provide a reason.
4. How to Exercise the Right of Withdrawal
Consumers must communicate their decision to withdraw from the contract through an explicit statement.
To make the request easier to manage, MAGUSA Marine provides a digital procedure accessible through the website and the customer account area, where available.
The digital function will be made available through a clearly visible link labelled “withdraw from the contract here”, or with equivalent wording, and in all cases through an easily accessible online function.
The function allows consumers to enter or confirm at least the following information:
- first name and surname;
- the email address used for the order;
- the order number;
- the product or service for which the right of withdrawal is being exercised;
- any additional information useful for managing the request.
The procedure includes a review and confirmation stage before the request is submitted definitively.
After submission, MAGUSA Marine will send the consumer confirmation that the withdrawal request has been received on a durable medium, such as by email, indicating the date and time of the request and a summary of the information provided.
Alternatively, the withdrawal request may be communicated by email to the address indicated in the “Contact Details” section of the website, or through any other statement that unequivocally expresses the consumer’s decision to withdraw from the contract.
Where possible, the request should include:
- the customer’s full name;
- the order number;
- the email address used for the purchase;
- the products for which the right of withdrawal is being exercised.
Once the communication has been received, MAGUSA Marine will send the consumer confirmation of receipt of the request on a durable medium.
5. Return of Products
After exercising the right of withdrawal, the consumer must return the products within 14 (fourteen) days from the date on which the withdrawal request was communicated.
Since MAGUSA Marine does not provide home delivery, products may be returned directly to the physical store during opening hours or, subject to prior agreement with customer support, through another agreed return method.
6. Condition of Returned Products
Consumers have the right to inspect and handle the product only to the extent necessary to establish its nature, characteristics and proper functioning.
Products must be returned complete with all accessories originally supplied, together with the original accompanying items and, where present, the original packaging.
The customer is responsible for any reduction in the value of the goods resulting from handling beyond what is strictly necessary to inspect the product and establish its characteristics and proper functioning.
Where the product shows signs of use incompatible with a normal inspection, alterations, damage, stains, abrasions, washing, modifications or tampering, MAGUSA Marine may apply Article 57 of the Italian Consumer Code and reduce the refund by an amount corresponding to the actual loss in value suffered.
7. Refunds
Where the right of withdrawal has been validly exercised, MAGUSA Marine will refund all payments received in relation to the products covered by the withdrawal request, using the same payment method used by the consumer for the original transaction, unless otherwise agreed.
The refund will be issued without undue delay and, in any event, within 14 (fourteen) days from the date on which MAGUSA Marine receives the withdrawal request.
MAGUSA Marine may withhold the refund until the returned goods have been received or until the consumer provides evidence that the goods have been returned, whichever occurs first.
Since online orders do not include home delivery, no shipping costs are eligible for reimbursement.
8. Exclusions and Limitations of the Right of Withdrawal
The right of withdrawal does not apply in the cases provided for under Article 59 of the Italian Consumer Code and applicable legislation.
By way of example and without limitation, the right of withdrawal may be excluded in relation to:
- goods made to the customer’s specifications or clearly personalised;
- sealed goods that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery;
- goods that, after delivery, have become inseparably mixed with other items;
- services that have been fully performed where performance began with the consumer’s express consent and acknowledgement that the right of withdrawal would be lost once the service had been fully performed, within the limits permitted by law.
Any specific exclusions will be indicated on the product page, during checkout or on the dedicated service page.
9. Legal Guarantee of Conformity
All products are covered by the legal guarantee of conformity provided for under Articles 128 et seq. of the Italian Consumer Code.
The legal guarantee is valid for 2 (two) years from the date of delivery of the goods and applies to conformity defects existing at the time the product is delivered.
In the event of a conformity defect, the consumer is entitled, free of charge, to have the goods brought into conformity through repair or replacement or, in the cases provided for by law, to receive a proportionate reduction in price or to terminate the contract.
To make use of the legal guarantee, customers are encouraged to contact MAGUSA Marine promptly, providing a description of the defect identified and, where possible, photographic documentation useful for assessing the case.
10. Product Exchanges
Outside the cases involving the right of withdrawal or the legal guarantee, requests to exchange a product, including exchanges relating to size, colour or item, may be accepted by MAGUSA Marine solely as a commercial courtesy and subject to the availability of the requested products.
An exchange does not constitute an independent consumer right, except where it relates to a conformity defect or another circumstance provided for by law.
11. Purchases Made in the Physical Store
This Policy applies exclusively to purchases made online through the website.
Purchases completed directly at the physical store are not subject to the right of withdrawal applicable to distance contracts, unless otherwise required by law or provided through a specific commercial initiative offered by MAGUSA Marine.
Any returns or exchanges relating to purchases made in the physical store may be assessed on a case-by-case basis in accordance with the conditions applicable at the time of purchase.

These documents respectively govern the general conditions applicable to purchases and services offered and the specific procedures governing the service.
Customers are encouraged to read these documents carefully before purchasing products or booking services, as they form an integral part of the contractual relationship with MAGUSA Marine.
In the event of any conflict of interpretation, the provisions consistent with mandatory consumer protection legislation shall prevail.
14. Policy Updates
MAGUSA Marine reserves the right to amend this Policy at any time, particularly in order to reflect regulatory, operational or technical changes.
The applicable version shall be the version published on the website at the time of purchase, except where amendments are required by mandatory provisions of law.
