Terms and Conditions of Sale and Services

These Terms and Conditions govern the use of the MAGUSA MARINE website, the placement and conclusion of online orders, in-store collection and the contractual relationship between MAGUSA MARINE and customers who purchase products or use services available through the website.

By using the website, completing an online order or requesting a service, the customer confirms that they have read and accepted these Terms and Conditions, together with the additional policies referred to and published on the website.

1. Purpose of the Service

MAGUSA MARINE provides an online sales service for selected products that can be viewed and purchased through the website. Orders are placed exclusively online and products must be physically collected from the designated store.

Home delivery is not available for products purchased online.

The website also enables customers to manage their customer account, access after-sales support and use any additional services that may be available, including the “Try On Board” service, which is governed by a dedicated policy.

2. Product Information

Product information is presented as accurately as possible and may include descriptions, characteristics, available variants, prices and other information intended to help customers make an informed choice.

Product images are provided for illustrative purposes and may not perfectly represent the actual characteristics of the product due to the device used, lighting conditions or photographic reproduction.

MAGUSA MARINE may update or amend website information and content at any time, without affecting the terms applicable to orders that have already been concluded.

3. Product Availability

Product availability is updated based on MAGUSA MARINE’s inventory management systems.

In exceptional circumstances, discrepancies may occur due to simultaneous orders, technical updates or synchronisation errors. In such cases, MAGUSA MARINE will inform the customer and may offer an alternative solution, cancel the order or issue a refund.

4. Prices

Product and service prices are stated in euros and include VAT, where applicable.

MAGUSA MARINE reserves the right to amend prices at any time. Price changes will not affect orders that have already been confirmed, except in the case of clear and obvious errors.

Any promotions or discounts are subject to the conditions displayed at the time they are used.

5. Online Orders

Customers can place an order by selecting the desired products, adding them to the shopping cart and completing the checkout process. Before confirming an order, customers must carefully check the selected products, quantities, any chosen variants, personal information and collection details.

The order is considered concluded when the customer receives confirmation by email or through another durable medium. The automatic acknowledgement that an order has been received does not, by itself, constitute acceptance of the order.

MAGUSA MARINE reserves the right not to accept or to cancel an order in the event of product unavailability, clear pricing or description errors, incomplete information, suspected misuse of the website or technical or operational impossibility of fulfilling the order.

6. Payments

Payment may be made using the payment methods available on the website during checkout.

Payments are processed through secure systems provided by third-party payment providers. MAGUSA MARINE does not directly store complete payment card details.

If a payment is unauthorised, declined or not completed, the order may not be confirmed or may be cancelled.

7. Collection from the Store

Orders placed through the website are available exclusively for collection from the MAGUSA MARINE store located at Via Salvatore Allende, Marina d’Arechi, Salerno, Italy.

Customers will be informed when their order is available for collection in accordance with the procedures described on the website, during the purchase process or through subsequent communications sent to the email address or other contact details provided.

At the time of collection, MAGUSA MARINE may request the order confirmation and an identity document in order to verify that the person collecting the order is authorised to do so and to ensure that the products are correctly delivered.

For the purposes of performing the contract, the product is considered delivered when the customer, or a third party appointed by the customer, takes possession of it by collecting it from the store.

The customer must collect the order within 15 (fifteen) days from the date on which they are notified that the order is available for collection.

If the customer is unable to collect the order within this period, they should promptly contact MAGUSA MARINE in order to agree, where possible, an alternative collection date.

If the initial 15 (fifteen)-day period expires without the customer collecting the order or agreeing an extension with MAGUSA MARINE, MAGUSA MARINE may send a reminder to the email address or other contact details provided by the customer, granting an additional period of no less than 15 (fifteen) days for collection.

If this additional period also expires without collection, storage and order management charges of €1.50 (one euro and fifty cents) will accrue for each subsequent day of storage, up to a maximum total amount of €50.00 (fifty euros).

If the customer does not collect the order within 30 (thirty) days from the notification that it is available and has not provided a justified reason for the delay, MAGUSA MARINE may terminate the contract by written notice.

If the contract is terminated, MAGUSA MARINE will refund the amounts paid by the customer within 14 (fourteen) days from the termination notice, using, where possible, the same payment method used for the purchase.

Any storage and order management charges accrued under this section will be deducted from the refund and offset against the amount owed to the customer by MAGUSA MARINE.

MAGUSA MARINE retains the right to claim compensation for any additional loss or damage suffered, where and to the extent permitted by law.

8. Additional Services

MAGUSA MARINE may provide additional services that are separate from the sale of products, including experiential or personalised services.

The conditions, operating procedures and contractual rules applicable to such services are set out in dedicated policies available on the website.

These services may include the “Try On Board” service, which is independent from the sale of products and is governed by a specific policy.

9. Customer Account

Customers may access their personal account area to view orders, requests and information relating to their account.

Customers are responsible for the accuracy of the information they provide and for keeping their login credentials secure.

10. Returns, Withdrawal and Guarantee

For purchases concluded online through the website, consumers benefit from the right of withdrawal within the periods and in accordance with the procedures provided under Articles 52 et seq. of the Italian Consumer Code, except in the cases excluded by law.

The exercise of the right of withdrawal, the procedures for returning products, refund periods, any limitations and the circumstances in which the right may be excluded are governed by the dedicated Returns, Refunds and Right of Withdrawal Policy available on the website, which forms an integral part of these Terms and Conditions.

11. Legal Guarantee of Conformity

All products sold by MAGUSA MARINE are covered, where applicable, by the legal guarantee of conformity provided under Articles 128 et seq. of the Italian Consumer Code.

Where a conformity defect existed at the time of delivery and becomes apparent within the statutory period, the customer is entitled to the remedies provided under applicable law.

Customers should report any defects promptly by sending a communication to the address indicated in the “Contact Details” section, specifying the order number, describing the identified defect and providing any useful photographic documentation.

Requests will be handled in accordance with applicable law.

12. Exchanges

Without prejudice to the rights arising from the legal guarantee of conformity and the right of withdrawal, MAGUSA MARINE may, at its discretion and subject to product availability, allow customers to exchange a product for a different size, colour or model.

Any exchange offered outside the customer’s statutory rights constitutes a commercial courtesy and does not grant the customer any additional rights beyond those provided by law.

13. Use of the Website

Customers agree to use the website lawfully and in compliance with these Terms and Conditions.

Any fraudulent, abusive or improper use that may compromise the operation of the service or the rights of third parties is prohibited.

MAGUSA MARINE may restrict or suspend access to the website in the event of violations, misuse or attempted fraud.

14. Intellectual Property

All website content, including text, images, photographs, logos, graphics, layouts, trading names and editorial content, is protected by intellectual property rights and belongs to MAGUSA MARINE or the respective rights holders.

Any unauthorised reproduction or use is prohibited.

15. Liability

MAGUSA MARINE makes every reasonable effort to ensure the proper operation of the website but cannot guarantee that the service will always be available without interruptions, maintenance periods, technical errors or circumstances beyond its control.

MAGUSA MARINE is not responsible for service disruptions resulting from external causes, force majeure events or improper use of the website.

All mandatory consumer rights provided under applicable law remain unaffected.

16. Links to Third-Party Websites

The website may contain links to websites or services operated by third parties. These links are provided exclusively for information or service purposes. MAGUSA MARINE does not control the content of external websites and accepts no responsibility for their content, services, privacy policies or contractual terms.

Access to third-party websites is undertaken at the user’s sole responsibility.

17. Protection of Personal Data

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR), Italian Legislative Decree No. 196/2003, as amended by Italian Legislative Decree No. 101/2018, and all other applicable data protection legislation.

Information regarding how personal data is processed is provided in the dedicated Privacy Policy published on the website, which forms an integral part of these Terms and Conditions.

The use of cookies and similar technologies is governed by the Cookie Policy and the preference management system available on the website.

18. Governing Law and Jurisdiction

These Terms and Conditions are governed by Italian law.

For any dispute relating to the interpretation, validity, effectiveness, performance or termination of the contract, where the customer qualifies as a consumer, the courts of the consumer’s place of residence or domicile shall have jurisdiction pursuant to Article 66-bis of the Italian Consumer Code.

Where the customer does not qualify as a consumer, the Court of Nocera Inferiore shall have exclusive jurisdiction, unless another mandatory jurisdiction is required by law.

19. Amendments

MAGUSA MARINE reserves the right to amend these Terms and Conditions at any time. The applicable version is the version published on the website at the time the order is placed.
